Adjustment of Status – This consists of applying for U.S. Permanent Residence also known as a “green card,” while present in the United States.

Family Based Green Card Petitions – U.S. citizens and lawful permanent residents can petition for non-citizen family members to join them in the U.S. The family-based immigration process consists of the filing of various forms and submission of many supporting documents. Fiancé Visas – U.S. citizens can petition for their fiancé (K-1) and their children (K-2) to enter the U.S. to get married here. Once married, the spouse can decide to return to their home country or stay and apply for a U.S. green card.

Consular Processing – Even with an approved relative petition, some non-citizens cannot adjust status (apply for a green card) in the U.S. and must return to their home country to be interviewed at a U.S. consulate or embassy there. This also applies to relatives outside of the U.S. seeking to enter the country based on a family-based petition. The process consists of filling out an online form, collecting various documents, and undergoing a medical examination. It is worthwhile to have an attorney assist to ensure there aren’t any unnecessary delays.

Petitions to Remove Conditions – Spouses who obtained their residence through a marriage petition prior to being married for two years, receive what is known as conditional permanent residence. This status lasts for two years, and the spouse must file to remove the conditions of their residence during the 90 days prior to the expiration of this status.
